General Terms and Conditions

Welcome to TOP.PH These Terms and Conditions (“T&C”) shall apply to the use and all transactions made through The Orange Platform mobile app (“TOP.PH,” “TOP,” “The Orange Platform”) and which may include the TOP website. By interacting in The Orange Platform App, you agree with, and are bound by the terms of this T&C.

The terms “The Orange Platform”, “The Orange Company”, “TOP.PH”,”TOP”, “Platform,” “we”, “us” and “our” as used in these T&C refer to The Orange Company, Inc., as well as its employees, directors, affiliates, successors, and assigns. The Orange Company, Inc., is a Filipino electronic money issuer, remittance company and operator of payment systems. 

The terms “user/s”, “account owner/s”, “account holder/s”, “sender/s”, “receiver/s”, “you”, “your” are the users of the service through the TOP.PH app. 

Please read the Data Privacy Policy in relation to how we process personal data collected from our app and other sites. 

The following definitions are used on TOP.PH and the following terms mean:

“TOP.PH” is an e-wallet application where a user can send and receive money seamlessly using mobile phones—users of TOP.PH can pay bills, buy prepaid loads, and purchase different products available in the mobile application. 

Transaction or account usage. The user of TOP.PH acknowledges that transactions done are initiated and processed through his TOP.PH application. TOP.PH shall be used for lawful e-wallet banking and other transactions allowed by AUB. Hence, the user of TOP.PH should have an existing verified mobile number, email address, and password upon registration to TOP.PH application to ensure the account’s legitimacy and that it was not used for unauthorized or illegal activities. The user should utilize TOP.PH for transactions of lawful and legitimate purpose only. 

Disputes on the account. The user should notify TOP of any error encountered or dispute on the account within thirty (30) calendar days from the transaction date. If the error or dispute encountered was not reported within 30 calendar days from the transaction date, TOP will not acknowledge the error and consider it correct and valid. Hence, TOP encourages users to monitor all transactions on their accounts regularly. 

Transactions and other transactions done in TOP.PH. User is solely responsible for their account on TOP.Ph in connection with purchasing any products available on TOP, such as paying bills, buying prepaid loads, and other products that can be purchased inside the app. 

TOP shall not be held liable for any action, liability, or claim that may arise between the user and the payee or any third party.

Hence, the account holder accepts full responsibility for all transactions done on TOP.Ph application, regardless of whether the same shall have been made without the user’s knowledge, authority, password, or PIN. All transactions done inside the app shall deemed by TOP as made with the understanding of the authorized user. 

Transactions done outside the jurisdiction of the Philippines that the user shall be subject to applicable laws, rules, and regulations of the Philippines and the country where the transaction was made. Hence, transactions made outside the Philippines shall apply to exchange controls and other rules or limitations implemented in the country. Transactions shall be subjected to transaction fees determined by TOP and AUB and the international network where the transactions occurred. 

Account Funding. Any fund received by the users through bank transfer or TOP to TOP or any accredited channel of TOP as may be determined or added by AUB or TOP from time to time. Hence, adding funds to the TOP wallet must be successful only after the verification by TOP, the date of which may or may not be the exact date when the fund transfer was made. 

User’s Responsibilities. The user hereby agrees to comply with the security implemented on TOP.Ph application and other security measures that AUB may implement. 

User Information. Users should agree with the TOP and AUB data privacy statements published on the TOP website. Hence, We may update this Data Privacy Statement to reflect changes to our practices or for other operational, legal, or regulatory reasons. The updated statement will be posted on our website and within our application.

Limitation of Liability of TOP. The user of TOP.Ph application, as a result of this, agrees to the resumption of TOP and AUB management, officers, and other personals to render and assign free and harmless form against any claim, cause of action, suit, liability, loss, or damage of whatever nature may arise as a result of in connection with the use of TOP.Ph application and the transaction made within TOP.Ph in the following instances:

  1. Failed or delayed concerning the use of mobile application of TOP due to circumstances beyond the control of TOP and AUB control and/or Act of God events but not limited to prolonged power outages, defects or computer-related errors, network errors. 
  2. Fraudulent and authorized transaction or use of the application due to Theft, unauthorized disclosure, or breach of security set on the application such as biometrics, tops with or without knowledge, and participation of the user. 
  3. Incomplete, inaccurate, or delayed information received by TOP and AUB due to failure of any communication facilities, network, or electronic device used for the TOP.Ph app. 

Loss or Theft of devices used for TOP.Ph. If devices are stolen or lost, the user should immediately report the incident to TOP.Ph customer support and request for account blocking. The user should be able to sign in to the app to another device to register to the device. If the user’s credentials are lost or compromised, the user is responsible for notifying and filing a report to the TOP.PH customer service or customer support to request assistance retrieving the account. The user might use the forgot password option in case this instance arises and proceed to the security measure implemented in the application to retrieve the said account. 

The user hereby understands and agrees that prior to TOP and AUB receiving notice from the user of any loss, theft, compromise, or corruption. All transactions done in the TOP.PH in the event of loss, Theft, or compromise of account shall be deemed conclusively binding upon the user. TOP and AUB shall not be liable for any loss and damage that may incurred by the user. 

Terms of Use of TOP.PH. The user of TOP.Ph application agrees to use the application for legitimate transactions. Hence, the user should not use the application for purchasing items or products that are importation into the Philippines of which is prohibited according to the law. TOP.Ph and AUB have the right to terminate the account of the user once proven that the user’s used their account for prohibited transactions. 

TOP.PH’s other terms and conditions. The Orange Company, Inc. reserves the right to modify these T&Cs. Any amendment will be published on our website and social media networking sites and will be sent through email thirty (30) days prior to effectivity. You have unconditionally accepted those amendments or updates if you continue to use the Services, this Platform, or register for an Account. 

We reserve the right at all times to change, modify, suspend, or discontinue any element of the Services accessed through the Platform, including payment methods, temporarily or permanently, without prior notice to you and without providing a reason, to the extent permissible under current local law and regulations. We may also restrict particular features or limit your access to some or all of the Platforms or Services.

We reserve the right to add additional functions, features, or programs to the Services or to later iterations. Unless otherwise specified, all new features, functionalities, updates, upgrades, and changes are subject to these Terms and Conditions.

We reserve the right to deny your access to the TOP.PH or Services or the ability to open an Account for any reason provided that current local laws and regulations do not forbid doing so.
